TERMS OF SERVICE (REGULAMIN SKLEPU)

1. Seller

The online store available at nakedcarstudio.eu (the "Store") is operated by DOMANI Sp. z o.o., ul. Twarda 18/15p, 00-105 Warszawa, Poland, entered in the Register of Entrepreneurs of the National Court Register (KRS) under number 0000804045, NIP: 7010945823, REGON: 384370529 (the "Seller"). Naked Car Studio is a brand used by the Seller in the Store.

2. Definitions

Customer means any person placing an order in the Store.

Consumer means a natural person concluding a contract not directly related to their business or professional activity. The provisions of these Terms concerning Consumers also apply to a natural person running a sole business who concludes a contract directly related to their business, where the contract does not have a professional character for that person (in particular in light of their registered business activity).

3. Products

The Store sells hand-polished 1/24 scale die-cast zamac car models designed as decorative wall objects. Each unit is finished by hand, so minor variations in the brushed metal surface are a natural feature of the product and not a defect.

Products are decorative collector's items for adults. They are not toys and are not intended for children under 14 years of age.

Product images are for illustration. Brand names and model names of vehicles are used solely to identify the depicted vehicle. Products are not produced, licensed, or endorsed by the respective vehicle manufacturers.

4. Prices and payment

All prices are gross prices in the currency shown in the Store and include VAT. Delivery costs are not included in the product price. They depend on the delivery option and the contents of the order and are shown in the order summary before the Customer places the order. Delivery is free for orders containing two or more models. The total price, including delivery, is shown before the order is placed. Available payment methods are displayed at checkout. Payment is processed by third-party payment providers. The Store does not offer cash on delivery.

5. Placing an order and conclusion of contract

To place an order, the Customer adds products to the cart, provides the data required for delivery, selects a payment method, and confirms the order with the button indicating an obligation to pay.

The contract of sale is concluded when the Customer receives an email confirming acceptance of the order. The Customer receives the content of these Terms together with the order confirmation on a durable medium (email).

6. Delivery

The Store delivers to member states of the European Union, except Malta. The estimated delivery time and shipping options are displayed at checkout. The risk of accidental loss or damage passes to the Consumer upon delivery of the product. Rules on parcels that are not collected or cannot be delivered are set out in the Shipping Policy.

7. Right of withdrawal

A Consumer may withdraw from the contract within 30 days of receiving the goods without giving any reason. This period is longer than the 14 days required by law; the extension is the Seller's voluntary guarantee and does not limit the Consumer's statutory rights. Details, including the model withdrawal form, return address and refund rules, are set out in the Refund Policy, which forms an integral part of these Terms.

The Consumer bears the direct cost of returning the goods to the Seller, unless the goods are damaged, faulty or not in conformity with the contract, in which case the Seller bears this cost.

8. Complaints and statutory warranty

The Seller is liable to the Consumer for any lack of conformity of the product with the contract that exists at the time of delivery and becomes apparent within two years of delivery, in accordance with the Polish Consumer Rights Act and applicable EU law. The Consumer may request repair or replacement and, in cases provided for by law, a price reduction or withdrawal from the contract.

Complaints may be submitted by email to kontakt@nakedcarstudio.eu. We recommend including the order number, a description of the issue, and photos, which will help us resolve it faster. The Seller will respond to a complaint within 14 days of receipt.

9. Electronic services

The Seller provides the Customer with free electronic services: browsing the Store, the order form, and (if subscribed) a newsletter.

Using the Store requires a device with internet access, an up-to-date web browser with cookies and JavaScript enabled, and an active email address. The Customer must not provide unlawful content.

Complaints regarding electronic services may be sent to kontakt@nakedcarstudio.eu and will be handled within 14 days. The newsletter service may be terminated at any time by clicking the unsubscribe link.

10. Relationship with Shopify

The Store is powered by Shopify, which enables the Seller to provide the Store's services. Any sales and purchases made in the Store are made directly with the Seller, DOMANI Sp. z o.o. Shopify is not a party to the contract of sale and is not responsible for any aspect of sales between the Customer and the Seller. This does not limit any rights the Consumer has against the Seller under mandatory law.

11. Automated agents

Software agents that act autonomously or semi-autonomously on behalf of a person ("Agents") may access the Store only if they identify themselves in the user agent string of each request as "Agent/[agent name]". Agents must not conceal that they are automated, circumvent CAPTCHAs or other measures distinguishing humans from computers, or bypass measures limiting automated access. The Seller may limit or block Agent access by technical means.

12. Out-of-court dispute resolution

A Consumer may use out-of-court complaint and redress procedures, including assistance from a municipal or district consumer ombudsman (rzecznik konsumentów), the Trade Inspection (Inspekcja Handlowa), or the European Consumer Centre in their country of residence. Using these procedures is voluntary.

13. Personal data

Personal data is processed in accordance with the Privacy Policy.

14. Final provisions

These Terms are governed by Polish law. For Consumers, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of their country of habitual residence. Disputes with Consumers will be resolved by the court competent under generally applicable law.

The Seller may amend these Terms for important reasons (e.g. changes in law). Amendments do not apply to orders placed before the change takes effect.
